1. Services

LabCertTech LLC provides cleanroom certification, biological safety cabinet certification, chemical fume hood certification, and related laboratory airflow testing services to facilities in Houston, Texas and surrounding areas. Our services are provided in accordance with applicable industry standards including USP 797, USP 800, ISO 14644, NSF/ANSI 49, and ASHRAE 110.

All services are subject to a separate service agreement or work order that defines the specific scope of work, pricing, and terms for each engagement. These Terms apply in addition to any such service agreement.

2. Website Use

You may use our website for lawful purposes only. You agree not to:

• Use our website in any way that violates applicable federal, state, or local laws or regulations
• Transmit any unsolicited or unauthorized advertising or promotional material
• Attempt to gain unauthorized access to any part of our website or systems

4. Certification Services — Terms and Conditions

4.1 Scope of Services

LabCertTech will perform the certification services as agreed upon in the applicable service agreement or work order. Our certification reports document the performance of your equipment and environment at the time of testing and do not constitute a warranty or guarantee of future performance.

4.2 Client Responsibilities

To enable LabCertTech to perform certification services effectively, the client agrees to:

• Provide safe and timely access to all equipment and areas to be certified
• Ensure that equipment is operational and ready for testing at the scheduled time
• Provide accurate information about equipment type, model, and operating parameters
• Notify LabCertTech of any known equipment deficiencies or safety concerns prior to certification
• Ensure that appropriate personnel are available to assist with access and coordination during the certification visit

4.3 Certification Reports

LabCertTech will provide written certification reports documenting the results of all tests performed. Certification reports are prepared based on conditions observed at the time of testing. LabCertTech is not responsible for changes in equipment performance or environmental conditions that occur after the certification visit.

4.4 Failed Certifications

If equipment or environmental conditions fail to meet applicable certification standards during testing, LabCertTech will document the failure in the certification report and provide recommendations for corrective action. It is the client’s responsibility to take corrective action and schedule recertification. LabCertTech is not responsible for operational decisions made by the client following a failed certification.

4.5 Scheduling and Cancellation

Certification appointments must be scheduled in advance. Cancellations or rescheduling requests should be made at least 48 hours prior to the scheduled appointment. Late cancellations or failure to provide access at the scheduled time may result in a cancellation or trip fee as specified in the applicable service agreement.

5. Payment Terms

Payment terms for certification services are specified in the applicable service agreement or invoice. Unless otherwise agreed in writing, payment is due upon completion of services. LabCertTech reserves the right to withhold certification reports until payment is received.

6. Limitation of Liability

To the maximum extent permitted by applicable law, LabCertTech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profits, loss of data, or business interruption.

LabCertTech’s total liability to you for any claim arising from our services shall not exceed the amount paid by you for the specific services giving rise to the claim.

LabCertTech’s certification services document equipment and environmental performance at the time of testing. We are not responsible for regulatory citations, inspection findings, or operational disruptions arising from equipment failures or environmental conditions that develop after the time of certification.

7. Disclaimer of Warranties

Our website and services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. LabCertTech does not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

Certification reports prepared by LabCertTech document test results as observed at the time of testing and do not constitute legal advice, regulatory compliance opinions, or guarantees of regulatory approval.

8. Indemnification

You agree to indemnify, defend, and hold harmless LabCertTech LLC and its officers, employees, and agents from any claims, damages, losses, or expenses — including reasonable attorneys’ fees — arising from your use of our website or services, your violation of these Terms, or your violation of any applicable law or regulation.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.

10. Changes to These Terms

We reserve the right to update these Terms at any time. We will post the updated Terms on this page with a revised effective date. Your continued use of our website or services after the posting of updated Terms constitutes your acceptance of the changes.
